Divorce In New Jersey And How It Impacts Child Custody

Experiencing divorce in New Jersey would be stressful for anyone, regardless of the location. The emotional damage cause is only increased when there are children involved in the situation. The eventual judgment on child custody can and will change the lives of you, your ex-partner, and your children. As many factors exist that could affect your outcome, be sure you are educated on what they are.

Many times involving cases of divorce in New Jersey, courts will find shared physical custody is the preferred method for the child. That way, each child will spend roughly equal time with each parent. Time would rotate at the kids' convenience.

Because there exists the chance that the court could decide that joint physical custody is better than shared physical custody, you should know what differences there are between these two conditions. In the former situation, the children would spend the majority of their time with one parent, but the other parent would still be involved as a parent. Both parents still make decisions about the children jointly, but they would still spend the majority of their time with a single parent.

If the court finds that one particular parent is most likely the best option for the kids, then that parent will be given sole legal custody. What this boils down to, is that one parent has full control of the kids and the other can offer their suggestions, but they can not make decisions on their own.

When going through a divorce in New Jersey with children involved, you should sit down with your attorney and discuss what is in the best interest of the children. The attorney will fight hard to represent your interests and the interests of the children and the courts make sure that the children's welfare is the top priority. If there is a dispute over the custody of the children, the court makes the determination on whether there should be joint custody, shared custody or if one parent should have sole custody. The ruling of the court is final.
