Searching For Public Divorce Records

by Claire Dowell

One of the many open state in the country is North Carolina. Being an open state would mean that the state allows its local residents to access their person files anytime they have a need for it. Divorce records in North Carolina are one of the public documents that local residents can access.

Divorce is the result of failed marriage and just like marriage; the divorce has to be documented to make it official. Once the couple has been legally separated, they need to update their status and other records in the government. In order to do so, they need to provide a copy of their separation papers to the government office. The request can be denied if the divorce certificate cannot be presented since it would serve as proof of their separation. Another use of such document is when one of the divorcees has plans of marrying again. Checking on the marital status during a background check would also require checking on the divorce record. This is commonly done by the people who want to make sure that they are dating a person who is not yet married or is separated legally.

A divorce certificate in North Carolina would contain details about the separation of a couple. One would know the complete names of the couple along with the details of their marriage such as the date and place where it took place. The document highlights details about when and where the divorce was filed and registered. Since divorce is a crucial and emotional event, not all its details are available for public access. Information such as the reason for the separation and the division of the couple's properties and assets are kept confidential. One cannot find information about the custody of the children on a public file since it is only visible to the individuals involved. All these information is kept private to respect the privacy of the divorcees.

North Carolina releases a copy of the divorce certificate if it occurred from 1958. A $24 processing fee has to be paid in order to get a copy of such document from the state. It is important that the one who requested for the document knows the basic details of the file being requested since it will be used during the retrieval process. Also, the state would only grant the request if it was made by the either one of the divorcees and their immediate family.

The public records of North Carolina are archived at the Vital Records Section of the state. One can go to the office to file the request for a copy of a divorce certificate. If the requested file is not available at the state office, it may be available at the county clerk office where the separation was filed and registered. A mail request can also be sent to the state office but this is not the fastest method to obtain the document since it may take days to get it.

Doing a California divorce records search online can help hasten the retrieval process. One just needs to log on to a website that offers to obtain the information for you. The search online can be done for free or for a certain fee. Many would go for the paid search to ensure that they get quality information.
