Basics Of Getting A Divorce In Singapore

by Kaye Bord

The social stigmas that divorce brings oftentimes hold back a married man or woman from stepping out of an unstable marital relationship. Such stigmas though are unavoidable and, yes, surmountable especially when the parties involved opt to seek the help of competent family lawyers in Singapore.

Reputable family lawyers in Singapore can help couples end their marital relationship without suffering from a lot of bitterness, humiliation and distress and can nullify their marital contracts with a fair hand through proper legal counsel. Marriages are contracts that bind two people to fulfill certain responsibilities they have to each other and to offspring they create in the marriage. When one or both party neglect these responsibilities, a petition for divorce can be filed to end such a contract.

Divorce in Singapore is governed by two laws. These are the Muslim laws and the Women's Charter (for non-Muslim). Muslim divorces are processed by the Muslim Law Court, commonly known as the Shariah Court. This entity is similar to the non-Muslim Supreme court and as such, this court can approve or reject the request of divorce through the decision of the president of the Shariah Court.

The Women's Charter Act is a parliamentary act that regulates monogamous marriages, the privileges and rights of wives as well as children, the duties and the rights of married people, the protection of women and divorce. This law allows either partner to file for a divorce on the following grounds: cruelty, adultery, living separately for seven years, three years after desertion, and mental illness. Also, women can file for divorce if their husbands committed rape, bigamy, sodomy and bestiality in the course of their union.

A person can petition for divorce as long as they meet the required three years of marriage before doing so and they should be residents of Singapore. Exceptions to these rules are made for those who have been married for under the required period of time. This is when the petitioner complains of exceptional hardship or the extreme depravity of their partner.
