During Custody Battles How Do You Keep Your Kids Safe

by Waldo Galati

When dreaming of our child's life we do not normal foresee a need to seek child custody. The child is caught more often than not, in the middle of battling parents. Sometimes, the parents less than fuzzy feelings for each other get in the way of their love for their children and their desire to spend the most time with that child: causing the parents to try to one up the other. The battle isn't always for worthy reasons though. If you are looking for help with your child custody case, here is some advice, in spite of what your reasoning may be.

If you think it might be helpful you can try a mediator instead of a straight up court. In some states, Family Court will insist upon you and your child's other parent meeting with a mediator before you see a judge. Don't worry about not being presented legally, your lawyer is still allowed with mediation. It's important for you to worry about truely working it out with the mediator. If you don't think the mediator has your best interest at heart you are allowed to ask for different mediators. You can ask that your lawyer explain the mediation process in depth so that you fully understand your rights going in.

Whether or not custody cases should go to court is an issue you will find both pros and cons for. And if you become familiar with them, they can help in your decision whether to go to court or not.

Even though most parents don't want to hear this, there are times where neither parent if given custody of the child in question. Once in a while, if the situation is particularly dire, a judge will award custody to another family member or appoint a guardian from within the child services system. If neither parent can prove that they deserve to be the sole provider for the household, the judge will resort to this less than ideal situation.

Whatever you do, try to cooperate with the other parent of your children. This will make you both look better if you have to take the matter to court. Put yourself in the other parents shoes. In no way does this mean that you have to give in to the other parent's demands though. Try to meet the other parent's needs or expectations, i fin doing so your child will remain safe and happy. And keep in mind, it is not about winning. It's about what is best for your kids.

Seeking the best situation for your child to be cared for, healthy and happy, should be your personal goal, regardless of the outcome.
