When Divorcing In Michigan Get An Attorney

In doing some research on divorce attorneys here in Southgate, Michigan, I came across some interesting information. I saw statistics in the trade news that stated there are about 6500 divorces a year in Wayne county alone. That's a lot of separations, child custody cases, and divorces, happening here in this area.

The way children are impacted in a divorce case can be heart wrenching. That's why through all the emotional clutter is important that your divorce attorney has the experience that will get you and your children a fair deal.

When there's a divorce with children, there's a statutory waiting period of 6 months before you can get divorced can be finalized. So maybe the idea here is to slow it down, to make you think twice if there's children involved. A divorce without children the waiting period is sixty-days. So that's one of the first questions your attorney should and must ask "do you have any minor children with your spouse?" So I can figure out is there going to be a divorce with children or without.

The next thing that your lawyer should focus in on is the length of the marriage. Is it a short term marriage or is it a long term marriage. And those words don't have any precise meaning, but in my mind, in most judges minds it would probably be 8, 9, 10 years that it would be considered a long term marriage. And why that's important is if there's a disparity in income in a long term marriage, then you're probably entitled to spousal support. A lot of people say oh I didn't know you can still get that. Does Michigan allow that? Of course they do. It's called spousal support or alimony. It's the same word basically. So, yes, so I definitely want to know is there a possibility of one party or the other side getting spousal support.

Then of course theres the question of property, is there a house or not? Any real property. And that just may add to the difficulty of the divorce because just about everybody that I talked to these days has a house that's under water, that's worth less than what they owe on it. So, that's always a problem when the parties are going to split up and who get's the house. Who get's the deficiency? What can be done about it? So in this day and age it's kind of tough some times. A lot of times the bank will take it back, but maybe not.

Divorce is an emotionally draining process and your attorney has to be your biggest advocate ensuring that you and your children receive a sustainable and fair deal. []
