New York Free Public Divorce Records

by Ben Kingsley

More married couple now files divorce if their marriage is no longer working. With this, an increase in the number of divorce records in New York can be observed, thus access to such documents is also increasing. The Freedom of Information Act has made the document open to the public making it easy for the local residents of the state to request for a copy of their divorce records.

Divorce records in New York are used in a number of reasons. One is for government transactions. There are certain transactions in the government that would require a copy of a divorce certificate such as insurance and updating the lit of dependents. Another important use of this document is for marriage applications. When a divorcee plans to marry again, a divorce certificate would have to be secured. Without it, marriage application may be denied.

Unlike a marriage record where all of the details about the event are indicated on the public file, a divorce certificate shows limited information to the public. One can only find the basic details about the separation. This includes the date and place where the separation was granted. Further details about the separation are kept confidential. One cannot find the reason why the couple decided to divorce. The name of the one who petitioned the separation remains private as well as the agreement on the properties and children. This was done to respect the privacy of the couple involved.

The state of New York allows retrieval of divorce records which are dated since 1963. A retrieval fee of $30 has to be prepared in order to process the request. One should know the basic details of the record that is being requested since it will be used as reference during the search. The requesting individual is also required to provide their contact details because it will be used to verify one's identity since the state only releases the document to the divorcees themselves and their immediate families. Others can still access the files of other people if they can secure an authorization to access it.

All of New York's public documents, including the divorce records of the state are kept at the office of the Department of Health under the Vital Records Section. One can personally go to the said office to file the request from there. In cases where the state office cannot provide the requested document, one can seek help from the office of the county clerk where the separation was legalized and see if they can help you with your search. The state office also accepts mailed-in requests but this is not the fastest method in obtaining such document as it can take days or weeks if there are problems with the given search parameters.

The state of New York now allows the retrieval of marriage and divorce records to be done online. This means that there is no need to go to any office just to file the request since it can be done even without leaving your own homes. This makes the retrieval fast and convenient for many. One can even get it for free through websites that offer a free search.
