Singapore Divorce - Do You Need A Lawyer?

Acquiring a divorce is often very heartbreaking for both parties involved. It's a very emotional topic and an intense legal process. It may also be very expensive for one or both of the parties. The entire process may prove to be challenging and complex, specifically if the sides have valuables to resolve and kids to look after. In Singapore, divorce is under the jurisdiction of two separate courts, the Family Court and the Syariah Court. For those planning to file for the end of their marriage, they need to consider the factors first.

For Singapore couples wedded under the Muslim law, they would be divorced under the rule of Syariah Court. But for non-Muslim married couples who are Singapore citizens, have lived in the state for at least three years prior to the divorce request, or are domiciled here, they can apply for divorce in the Family Court. Under the law of <a href='http://www.regentlaw.com.sg/practise-areas'>Divorce in Singapore</a>, unless they have the Court's consent to do so, couples who have been married for less than three years cannot apply for divorce.

Though it's not a requirement in court to hire <a href='http://www.regentlaw.com.sg/lawyer/2012/singapore-lawyers'>lawyers for divorce</a>, it would be very helpful for each side to employ one because the whole course can be very emotional and mentally exhausting. If a person chooses to act in person, or do without the support of a counsel, he or she is still expected to submit to the legal, procedural, and formal conditions of court proceedings just like everybody else. This may be too complex for a person who doesn't have formal training in law.

They also will not be getting any legal assistance from the Family Court. Whereas if they appoint a counsel, they can make sure that every step they make is in line with the law. They will also be able to respond properly to court summons and talk to the other camp on their client's behalf so they can avoid the stress caused by the process.

A divorce doesn't need to be bitter, but sadly, this happens a lot. The process in Singapore may take a long time and become more costly if one of the camps challenges the divorce. The spouses may prevent contested divorce, however, if they can come to an agreement. With the help of their lawyers to ensure that the matter will be dealt with objectively, they can request for an amicable agreement.
