3 Common Divorce Law Issues

Getting a divorce is one of the most trying events of a person's life. To make matters worse, it can take a long time, especially when spouses don't agree on all the terms of divorce.

3 commonly disputed issues in a divorce are child custody, property division, and spousal support.

1. Child Custody

In times past it was highly unusual that the father would end up with custody of a child. However, these days it's becoming more and more common that fathers do get custody of the children.

It's also more frequent that parents will enter into shared custody where both parents make arrangements to have custody of the children at certain durations. If this can be arranged, it can be an ideal arrangement, especially for the children. That said, for this to work, it's best when the parents get along (a tall order in some cases).

2. Property Division

Property division laws change among jurisdictions. However, more and more jurisdictions have enacted laws that dictate property is divided equally. Of course there are exceptions and an overriding provision is that the assets in question be family assets. Therefore, often a dispute arises as to what is a family asset.

A family asset is any asset ordinarily used for the family. It can be personal property, land, vacation properties, investments, and businesses.

3. Spousal Support

Spousal support is also called alimony. Spousal support is not awarded as generously as it used to be largely because more and more women work and have careers. Notice I said women, because historically it was rare men would receive spousal support (although not unheard of).

Although spousal support is not awarded as liberally as it once was (generally speaking), it can still be a contentious issues, especially when one spouse stayed home for a number of years caring for children. Being out of the workforce results in a career disadvantage for many, and so spousal support is designed to reduce that disadvantage.
