New York Divorce Court Records Free Reference

A drastic increase in the number of divorce cases came about in New York in the 19th century that eventually led to the creation of vital public records. Included in the records are the New York Divorce Records. To start a search, it is highly recommended to go to the New York Vital Records Office. Details about these records are kept and maintained in the county where the divorce took place. Divorce records reveal information about the terms and conditions of the case, and other important particulars of the divorce.

2 certified copies are available for the view and copy of the public. One is the divorce decree and the other is the divorce certificate. The first one shares the terms and conditions of the divorce case while the latter shares information about the couple, date and place of divorce. The first one is the only document given if the divorce occurred before January 1, 1963. It is signed by the judge who issued the decree at the county where it happened. The latter is given to those cases filed after January 1, 1963. Divorce records are available for view of the public but only either spouse can obtain it or any person granted permission by the New York State Court order.

A person can choose any of the several ways to obtain such records. They can be requested through walk-in, fax, phone, mail or through the use of the internet. Fees are required in each of the ways to get a copy of the records. Through mail, a fee of $30 per copy of the divorce records is charged if handled regularly and a $15 additional fee if handled with priority. Requests made from outside of the United State are also accepted through mail. A major credit card is needed for requests made through internet or the telephone and an additional $7.25 fee since these types of request is done through the help of commercial record keepers.

Requests with priority handling saves more time than those with regular handling. Priority handling cuts the time of processing the records, making the 6-8 week processing period into a 2-4week processing period. Requests made through the phone or the internet takes the shortest time to process, with just between 5-10 working days processing period. All applications must be submitted with recent identifications and a valid reason for requesting for such records. Identification includes driver's license, passport, US Military issued ID's, State issued non-driver photo-ID, proof of billing and any letter or notice from any government agency within the past 6 months. The incapacity to include any of the requirements will prevent the request from being accepted or approved.

Anyone is allowed to obtain divorce records as long as proper procedures are observed. Divorce records are public records and can be viewed and accessed by anyone.
